Kavanaugh No Longer a Midterm Boon for Republicans

New York Times: “With Judge Kavanaugh and his accuser, Christine Blasey Ford, tentatively scheduled to testify this week before the Senate Judiciary Committee, and many women furious over President Trump’s attacks on Dr. Blasey, a Supreme Court nomination that was once seen as a political winner in many conservative-leaning states could, instead, rouse female voters and independents who otherwise may have cared little about the confirmation fight.”

“Suburban women are pivotal in this year’s campaign and many of them were already tilting toward Democrats because of their contempt for President Trump. If Republicans are too harsh in their questioning of Dr. Blasey, they risk inviting an even greater backlash at the ballot box in an election where their House majority is in peril and their one-vote Senate majority is teetering.”

Republicans Boot Their Problems Until After Midterms

“Congressional Republicans have found a solution to all their internal problems that plague their party: Delay them until after the midterms,” Politico reports.

“As the GOP fights to confirm Brett Kavanaugh to the Supreme Court, House Speaker Paul Ryan and Senate Majority Leader Mitch McConnell are seeking to make as few political errors as possible before November. But they are setting up a lame duck that will be characterized by a race to replace Ryan, a government shutdown fight and brutal divisions on several long-shot pieces of legislation that will quickly morph into a nightmare for the party no matter the results of the elections.”

Bad News for Minnesota Republicans

A new Mason-Dixon poll in Minnesota finds President Trump’s approval rating has dropped from 45% to 39%, while 56% disapprove of his handling of the job.

“In other results, Democrats are safely ahead of Republicans in nearly every major statewide race. Rep. Tim Walz (D) leads Jeff Johnson (R) by 9 points in the governor’s race, Sen. Amy Klobuchar (D) is up big over Jim Newberger (R), and Sen. Tina Smith (D) leads state Sen. Karin Housley (R) by 7 points.”

“The only real bright spot for Republicans? Doug Wardlow (R) is within striking distance of Rep. Keith Ellison (D) in the attorney general contest, though still trailing by 5 percentage points, with 18 percent undecided. That’s after Ellison was accused by an ex-girlfriend of domestic abuse, which he denies.”

Tentative Deal Reached for Thursday Hearing

“The Senate Judiciary Committee and lawyers for the woman who has accused Judge Brett Kavanaugh of sexually assaulting her when they were teenagers reached a tentative agreement on Saturday for her to publicly testify on Thursday, an apparent breakthrough in halting negotiations,” the New York Times reports.

“After a brief call late on Saturday, the lawyers and aides to Sen. Charles Grassley (R-IA), the Republican chairman of the Judiciary Committee, planned to talk again Sunday morning to continue negotiations over the conditions of the testimony.”

“Negotiations could still falter over those details, which include who will question the woman, Christine Blasey Ford. But in tentatively agreeing to a Thursday hearing, Republicans made a significant concession that suggested they were working to ensure that the session occurred after several days of uncertainty.”

Washington Post: “This time, the questions were much different. An array of White House aides, playing the role of various senators on the Judiciary Committee, quizzed Kavanaugh last week about his sex life and other personal matters in an attempt to prepare him for a hearing that would inevitably be uncomfortable.”

“In his answers during the practice runs, aides said, Kavanaugh condemned sexual assault and carefully avoided seeming to discredit Christine Blasey Ford, a psychology professor in northern California who has accused the nominee of pinning her to a bed, groping her and putting his hand over her mouth to stifle her screams as he tried to take off her clothes at a drunken high school party in the early 1980s.”

“But Kavanaugh grew frustrated when it came to questions that dug into his private life, particularly his drinking habits and his sexual proclivities… He declined to answer some questions altogether, saying they were too personal.”

Pompeo Suggests Rosenstein Is In Danger

Secretary of State Mike Pompeo “hinted that Rod Rosenstein could be in jeopardy, after reports on Friday said the deputy attorney general discussed wearing a wire to record conversations with Donald Trump and the possibility of invoking the 25th amendment to remove the president,” the Guardian reports.

Said Pompeo: “If you can’t be on the team, if you’re not supporting this mission, then maybe you just ought to find something else to do.”

Asked by Fox News host Chris Wallace if Rosenstein’s reported behavior would constitute “being on the team,” Pompeo said: “Not remotely.”

Republicans Are Backed Into a Corner Over Kavanaugh

As the day began, there were three possible outcomes in the high stakes showdown over whether Christine Blasey Ford would accept the Senate Judiciary Committee’s invitation to testify against Brett Kavanaugh:

  1. Ford could reject the invitation, which would give Republicans on the committee the political cover they needed to vote in favor of Kavanaugh’s nomination as soon as Monday afternoon.
  2. Kavanaugh could withdraw his nomination, deciding the high profile fight was just not worth the personal cost to him and his family.
  3. Ford could accept the invitation, allowing her to tell her story in the most public of settings.

Ford has reportedly accepted the invitation to testify, although “details” still need to be finalized. The Washington Post reports that Ford’s attorneys “will continue to push for their other demands.”

This is easily the worst outcome for Republicans.

If Ford testifies, Republican senators will be put in the position of deciding whether or not they believe her accusations. The best case scenario is that they can say they still do not know the truth after hearing testimony from Ford and Kavanaugh. But that will only raise the question of why they will not allow additional witnesses to testify and it will highlight that Republicans refused to ask the FBI to independently investigate the matter.

The worst case scenario is that the 10 Republican men on the committee will attack Ford in an effort to undermine her testimony, claim to believe Kavanaugh and further erode the party’s support among women just weeks before the midterm election.

Either way, Republicans have little incentive to let this hearing go forward. I wouldn’t be surprised if the remaining “details” are too much for them to work out.

Republicans have backed themselves into a corner with no good options.

Kavanaugh Accuser Agrees to Testify

Lawyers for Christine Blasey Ford say that she has accepted the invitation to testify before the Senate Judiciary Committee against Supreme Court nominee Brett Kavanaugh, who she has accused of sexually assaulting her when they were both in high school, the Washington Post reports.

The hearing is presumably scheduled for Wednesday. Ford’s lawyers asked the committee for a call later Saturday to work out other specifics.

New York Times: “It is now up to Mr. Grassley to decide whether to grant Dr. Blasey’s wish for further negotiations or move ahead with a committee vote on Judge Kavanaugh’s Supreme Court nomination scheduled for Monday.”

Court Filing Alleges Ex-Trump Aide Drugged Woman

“The ongoing custody battle between former Trump campaign operatives Jason Miller and A.J. Delgado has taken another nasty turn: In an explosive new court filing, Delgado’s legal team alleges that Miller—prior to their own high-profile extramarital romance—carried out an affair with a woman he met at an Orlando strip club,” Splinter reports.

“Additionally, the court documents claim, when the woman found out she was pregnant, Miller surreptitiously dosed her with an abortion pill without her knowledge, leading, the woman claims, to the pregnancy’s termination and nearly her death.”

Trump Vows to Rid Justice Dept of ‘Lingering Stench’

President Trump vowed to eradicate a “lingering stench” at the Justice Department, hours after it was reported that Deputy Attorney General Rod Rosenstein discussed wearing a “wire” to record conversations with Trump and recruiting Cabinet members to invoke the 25th Amendment to remove him from office, CNN reports.

Said Trump: “I want to tell you, we have great people in the Department of Justice, we have great people. These are people, I really believe, you take a poll, I got to be at 95%. But we had some real bad ones — you see what’s happened at the FBI, they’re all gone, they’re all gone, they’re all gone. But there’s a lingering stench and we’re going to get rid of that, too.”

Judge Says Wilbur Ross Can Be Deposed

“A federal court ruled that a Cabinet secretary must provide, for the first time in 19 years, a deposition in a civil case,” Politico reports.

“The Cabinet member, Commerce Secretary Wilbur Ross, must answer questions about the inclusion of a citizenship question on the 2020 Census.”

Said U.S. District Judge Jesse Furman: “Applying well-established principles to the unusual facts of these cases, the court concludes that the question is not a close one. Secretary Ross must sit for a deposition because, among other things, his intent and credibility are directly at issue in these cases.”

Garrett Ventry, a press adviser helping lead the Senate Judiciary Committee’s response to a sexual assault allegation against Supreme Court nominee Brett Kavanaugh, “has stepped down amid evidence he was fired from a previous political job in part because of a sexual harassment allegation against him,” NBC News reports.

“Republicans familiar with the situation had been concerned that Ventry, because of his history, could not lead an effective communications response.”

Meanwhile, Politico reports that Ventry previously worked for the public relations firm that guided the mistaken identity Doppleganger theory in defense of Kavanaugh.

Christine Blasey Ford Wanted to Flee the Country

“When Donald Trump won his upset presidential victory in 2016, Christine Blasey Ford’s thoughts quickly turned to a name most Americans had never heard of but one that had unsettled her for years: Brett M. Kavanaugh,” the Washington Post reports.

“Kavanaugh — a judge on the prestigious U.S. Court of Appeals for the District of Columbia — was among those mentioned as a possible replacement for Supreme Court Justice Antonin Scalia, who died in 2016. When Trump nominated Neil M. Gorsuch, Ford was relieved but still uneasy.”

“Ford had already moved 3,000 miles away from the affluent Maryland suburbs where she says Kavanaugh sexually assaulted her at a house party — a charge he would emphatically deny. Suddenly, living in California didn’t seem far enough. Maybe another hemisphere would be. She went online to research other democracies where her family might settle, including New Zealand.”
