Gorsuch Refused Request from Chief Justice to Wear Mask

“They all did. Except Gorsuch, who, as it happens, sits next to Sotomayor on the bench. His continued refusal since then has also meant that Sotomayor has not attended the justices’ weekly conference in person, joining instead by telephone.”

Supreme Court Blocks Biden’s Vaccine Mandate
The Supreme Court blocked President Biden’s vaccine-or-test rule for large U.S. businesses, but allowed the vaccine mandate to stand for most federally-funded health care facilities, the AP reports.
New York Times: “The vote in the employer mandate case was 6 to 3, with liberal justices in dissent. The vote in the health care case was 5 to 4, with Chief Justice John Roberts and Justice Brett Kavanaugh joining the liberal justices to form a majority.”
Gorsuch Is Only Justice to Not Wear Mask on Bench
Supreme Court Justice Neil Gorsuch did not wear a mask for a hearing Tuesday, even as all the other justices in attendance did so, and as two of his colleagues — Stephen Breyer and Sonia Sotomayor — appeared remotely due to apparent concerns about Covid-19, CNBC reports.
Justices Skeptical of Biden’s Vaccine Mandate

Judges Have Reduced Proposed Sentences for Rioters
Washington Post: “Federal judges in D.C. have gone below the government recommendation in 49 out of 74 sentencings held for Capitol riot defendants one year after the attack, about two-thirds of the cases. In eight cases where prosecutors asked for jail time, the judges instead opted for probation. Of the 74 people sentenced so far, 35 have been given jail or prison time, 14 home detention and 25 probation alone.”
Roberts Says Judges Must Avoid Financial Conflicts
“Supreme Court Chief Justice John Roberts says the federal judiciary needs to do more to ensure judges don’t participate in cases where they have financial conflicts of interest,” the AP reports.
“Roberts made the comments as part of his annual report on the federal judiciary released Friday evening.”
Louisiana Judge Resigns Over Racial Slurs
A Louisiana judge has resigned weeks after a video from her home showed her repeatedly using the N-word, KLFY reports.
Judge Michelle Odinet blamed the incident on her “fragile” mental state at the time and use of sedatives.
Another Rally Was Planned for January 6
“The same people who organized Trump’s fateful rally on the Ellipse had something else in store on Jan. 6: a separate, previously unreported rally planned in front of the Supreme Court,” TPM reports.
“In the end the organizers delayed, then aborted the Supreme Court rally as the assault on the Capitol unfolded and roads around the building were blocked.”
Federal Appeals Court to Hear Texas Abortion Case
“A federal appeals court said Monday it will hear oral arguments Jan. 7 in a high-profile case centered on the country’s most restrictive abortion law,” NBC News reports.
“The 5th U.S. Circuit Court of Appeals, based in Louisiana, scheduled the hearing after the Supreme Court this month declined to block enforcement of the Texas law known as S.B. 8 while allowing abortion providers in the state to proceed with their legal challenge.”
Trump-Appointed Judges Haven’t Hampered Biden Much
Vox: “In just four years as president, Trump remade the federal judiciary — all with a big assist from a Senate Republican leader willing to break any norm in order to ensure GOP control of the courts. Trump appointed a third of the Supreme Court and nearly a third of all active appeals court judges.”

“Chief Justice John Roberts earns the highest job approval rating of 11 U.S. leaders with 60% approving of how he is handling his role,” according to Gallup.
“Only two other leaders on the list are reviewed positively by majorities of Americans — Federal Reserve Chairman Jerome Powell (53%) and Director of the National Institute of Allergy and Infectious Diseases Dr. Anthony Fauci (52%).”
Trump Asks Supreme Court to Block Release of His Records
“Lawyers for former president Donald Trump asked the Supreme Court on Thursday to block release of his White House records to a congressional committee investigating the Jan. 6 attack on the U.S. Capitol,” the Washington Post reports.
“Trump wants the justices to reverse a unanimous ruling from the U.S. Court of Appeals for the D.C. Circuit, which rejected his assertions of executive privilege and request to keep secret roughly 800 pages of Trump’s papers. President Biden determined the material could be released to the committee.”
Supreme Court to Decide on Biden’s Vaccine Mandate
“The Supreme Court Wednesday night announced it will hold a special hearing next month to consider challenges to the Biden administration’s pandemic efforts to impose a nationwide vaccine-or-testing requirement for large employers and a separate coronavirus vaccine mandate for health-care workers,” the Washington Post reports.
“Both have been at least partially blocked from going into effect by lower courts after challenges from Republican-led states and from business and religious coalitions.”
“It is highly unusual for the justices to schedule such hearings on emergency requests.”

“Senate Republicans are poised to deny President Joe Biden an appointment to the Supreme Court if they take the majority in the 2022 midterm elections,” CNN reports.
“Five Republican senators raised the stakes around Justice Stephen Breyer’s retirement, telling CNN they’d oppose any likely nominee out of this White House.”
