Paul Rosenzweig: “In this first year of his second term, President Donald Trump has claimed broad powers to unilaterally restructure much of how the U.S. government functions. Some of these assertions have gone completely unchallenged. Others have been litigated, and although lower courts have been skeptical of many of these efforts, the Supreme Court has been more approving. Trump has taken as much advantage of his new powers as he plausibly can, prosecuting his political enemies, firing independent agency heads, and dismantling federal agencies almost at a whim.”

“One salient question now is: When and if the Democrats return to power, how much of Trump’s damage can they undo? Let’s assume, for the moment, that the Supreme Court acts in good faith—that its views on presidential power are without partisan favor, and that it doesn’t arbitrarily invent carve-outs to rein in a Democratic president. What then?”

“Even with such (unlikely) parameters, the outcomes of this thought experiment suggest few opportunities for a Democratic president to make positive use of these novel presidential powers.”

“Together, the actions will facilitate exports of U.S. technologies and boost the build-out of data centers — advancing the agenda of executives and investors seeking to cash in on an AI gold rush.”

Fast Company: “What happens when you spend decades seeding salacious stories about evil lurking in the halls of power, demanding evidence to prove basic truths, and questioning the veracity of that evidence once it’s presented?”

“Over the last week, the president has been trying to fight his way out of a web of his own creation, as some of his truest followers in MAGA world call for the full release of the government’s investigative files concerning convicted child sex offender Jeffrey Epstein. The outcry from Trump acolytes comes after the Department of Justice published a two-page memo earlier this month, stating that Epstein’s supposed “client list,” which Attorney General Pam Bondi previously said was on her desk, didn’t actually exist.”

At a reception with members of Congress last night, President Trump claimed that the festering scandal regarding the Epstein files had actually made his poll numbers improve, Mediaite reports.

Said Trump: “I have the best numbers I’ve ever had. You know, it’s amazing, I watch people on television, ‘Well, what about Donald Trump’s polling numbers?’ Yeah, they’re the best numbers I’ve ever had.”

He added: “And with this made-up hoax that they’re talking about, my numbers have gone up four and five points. They want to do anything to get us off the subject of making America great again, and we’re not gonna put up with it.”

“Mr. Lawler had been openly exploring a campaign against Gov. Kathy Hochul, a Democrat, for months. Many Republicans viewed the congressman, who has consistently won in a Democratic-leaning district, as their most viable candidate in a left-leaning state.”

“Without much notice, the Education Department has suspended student loan forgiveness under a long-standing repayment plan, offering no timeline for resumption and little explanation for the decision,” the Washington Post reports.

“Income-Based Repayment is one of four federal plans that tie monthly payments to earnings and family size with the promise of loan forgiveness after 20 or 25 years of payments. It is the only income-driven plan that is not affected by a court injunction and, therefore, was the only one still processing loan forgiveness… About 2 million borrowers are enrolled in the plan.”

“The leadership of the U.S. attorney’s office in New Jersey was thrown into confusion on Tuesday as top Justice Department officials pushed back after federal judges in the state moved to appoint a new U.S. attorney,” the New York Times reports.

“The panel of federal judges rejected Alina Habba’s bid to stay in the job as the state’s U.S. attorney. Instead, they invoked a rarely used power to select a candidate of their own, Desiree Leigh Grace, an experienced prosecutor whom Ms. Habba had named as her first assistant soon after she took over as interim U.S. attorney in March.”

“But the attorney general, Pam Bondi, responded Tuesday evening with a social media post defending Ms. Habba and saying that the first assistant — Ms. Grace — ‘has just been removed.’”

Playbook: “It has the makings of the next big Trump legal fight over the judiciary, even though the place of courts in filling U.S. attorney roles until Senate confirmation has been upheld by Congress before.”

“Economists at the Wall Street firm expect gross domestic product to rise at just a 1.1% annual pace through 2025 ‘as the growing real income drag from tariff-related price increases offsets the boost from easier financial conditions.’”
