Bevin Dismisses His Bad Poll Numbers

Kentucky Gov. Matt Bevin (R) “dismissed polling that shows him struggling with voters as he runs for a second term — and said he welcomes having President Trump and vice president Mike Pence come to Kentucky to campaign for him,” McClatchy reports.

Said Bevin: “There has never been a poll ever taken… done by anyone, including people who want to be supportive, that has ever found me above water or likely to win anything, ever. I have never led in any poll or been popular in any survey that has ever been done.”

The Mueller Report We’ve Already Seen

Philip Bump: “President Trump has benefited enormously from the frog-in-hot-water nature of special counsel Robert Mueller’s investigation into his campaign and possible overlap with Russian efforts to influence the 2016 election.”

“America has been waiting for Mueller to present a document that ties all of this together — eager, in part, for evidence proving the president’s guilt, or exonerating him, on charges that he and his campaign worked with the Russians. As people have awaited the outcome, the slow accretion of malfeasance that Mueller has already uncovered has faded into background noise. It has allowed Trump to lump every new revelation into a big snowball labeled ‘no collusion,’ parroting the same refrain as the snowball grows. Meanwhile his opponents, waiting for a smoking gun, are happy to keep looking forward as well.”

What Beto O’Rourke Could Unleash on Trump

Sasha Issenberg: “O’Rourke is now on the precipice of running for president with ‘losing Senate candidate’ as the most impressive line on his résumé. It was how he chose to run that campaign last year that sets him apart from his potential Democratic rivals. O’Rourke cast aside the hard-won heirlooms of Barack Obama’s campaigns: a vogue for data science, the grooming of a professional organizing class and a dedication to the humanism of one-on-one tutelage. Instead, his campaign followed principles that more closely resemble what Silicon Valley types call ‘hyperscale’—a system flexible enough to expand at exponential speed, paired with an understanding that getting big quickly can excuse and justify all kinds of other shortcomings.”

“In political terms, it amounted to a massive bet on a strategy of mobilizing infrequent voters instead of trying to win over dependable ones. National campaign strategists are paying close attention to how O’Rourke did it: Few candidates have committed as fully, if a bit recklessly, to the belief that a monomaniacal focus on large-scale turnout is the most powerful tool Democrats have to capitalize on their latent numerical majority in the United States.”

New York Will Charge Manafort If Trump Pardons Him

“New York state prosecutors have put together a criminal case against Paul Manafort that they could file quickly if the former chairman of Donald Trump’s 2016 campaign receives a presidential pardon,” Bloomberg reports.

“New York County District Attorney Cyrus Vance Jr. is ready to file an array of tax and other charges against Manafort… something seen as an insurance policy should the president exercise his power to free the former aide. Skirting laws that protect defendants from being charged twice for the same offense has been one of Vance’s challenges.”

New York Times: “They resumed their investigation in recent months, and a state grand jury began hearing evidence in the case… The panel is expected to wrap up its work in the coming weeks and prosecutors likely will ask the grand jurors to vote on charges shortly thereafter.”

New Jersey Bill Would Keep Trump Off the Ballot

“New Jersey Democrats are reviving a controversial effort to force President Trump to release his tax returns or be denied a spot on the state’s 2020 ballot,” North Jersey reports.

“The state Senate on Thursday approved a bill — which the Legislature passed once before, in 2017, but which then-Gov. Chris Christie blocked by issuing a scathing veto — that would prohibit candidates for president and vice president from appearing on the ballot unless they make their tax returns public.”

“Similar legislation has been introduced in at least 30 states but never enacted.”

Trump Says ‘Witch Hunt’ Must End

President Trump called the Russia probe a “witch hunt” again in a new tweet and called for it to end.

He promised in December: “We will be doing a major Counter Report to the Mueller Report. This should never again be allowed to happen to a future President of the United States!”

Congress Could Block Much of Trump’s ‘Emergency’ Fund

Roll Call: “More than one-third of the money President Trump wants to redirect from other federal programs to build a border barrier is likely to be unavailable from the sources he has identified. As a result, it may be difficult for the president to circumvent Congress, even if a resolution disapproving of his ’emergency’ moves is never enacted.”

“Trump announced Feb. 15 that, using emergency powers, he wants to divert as much as $6.7 billion from other programs to finance the construction of barriers along the U.S.-Mexico border. That includes $3.6 billion from unspent military construction money, $2.5 billion in unspent Pentagon counterdrug funds and $600 million from a Treasury Department asset forfeiture account.”

“But the Defense Department has told lawmakers that only $85 million remains unspent in the counterdrug account… The Pentagon is planning to ask Congress for authority to reprogram more than $2.4 billion from other military programs into the counterdrug account in order to then take it right back out and move it to the wall project.”

The Last Redo of a Congressional Election

With a new election called in North Carolina due to fraud allegations, Ally Munick points out that last redo of a congressional election was in January 1975 in Louisiana’s 6th congressional district.

The New York Times reports Henson Moore (R) led Jeff LaCaze (D) led by 44 votes on Election Night 1974, but it was determined that “a malfunctioning voting machine could have changed the outcome.” After a state court ordered a new election, Moore won easily.

CNN: “It is the last major requisite court filing in Mueller’s longest running case, a sprawling prosecution of the former Trump campaign manager that led investigators to gather exhaustive information about his hidden Cypriot bank accounts, Ukrainian political efforts in Europe and the U.S. and into Manafort’s time on the 2016 presidential campaign.”

“Prosecutors are set to outline all facts they believe the judge should consider at his sentencing, now set for March 13. That will likely include Manafort’s criminal business schemes, his attempt to reach out to key contacts after his arrest and the lies he told to prosecutors and a grand jury after he agreed to cooperate with the Mueller investigation.”

Trump Stays Silent on Media-Hating Coast Guard Officer

“Even after facing public criticism over his spotty voting record, Howard Schultz failed to vote in this month’s Seattle school-levy election,” the Seattle Times reports.

“King County Elections records show a postage-paid ballot for the Feb. 12 special election was mailed to the billionaire former Starbucks CEO and potential presidential candidate on Jan. 23, but never returned.”

“The no-show was in line with Schultz’s pattern of ignoring many elections over the decades, even while urging increased civic and political involvement by Americans.”

Sanders Starts Out Way Ahead of Warren

“The Bernie Sanders vs. Elizabeth Warren primary is on. The run-up to their presidential announcements sparked concern on the left that having both of them in the race would split the activist base and clear the way for a more moderate nominee. Now that they’re both in, the competition between the two promises to be one of the more intriguing subplots of the primary,” Politico reports.

“Sanders starts out indisputably ahead. Bolstered by the grassroots army he amassed in 2016, the Vermont senator easily outraised Warren in the first 24 hours of their campaigns. “Inside the administration, concern about the upcoming summit has come from predictable skeptics, including national security adviser John Bolton, a longtime opponent of diplomacy with North Korea, but also from unexpected corners. Secretary of State Mike Pompeo, the man charged with leading the negotiations, has expressed frustration to allies about the lack of diplomatic progress and voiced concern that his boss will get outmaneuvered, according to a source with direct knowledge of the conversations.”

“But Risch, the newly minted chairman of the Senate Foreign Relations Committee, wasn’t eager to preside over an intraparty fight. And so he quickly began working to calm GOP senators — even giving potentially misleading information.”
