Supreme Court to Review DACA Program

“The Supreme Court announced Friday it will take up next term whether the Trump administration illegally tried to end the program that shields from deportation young undocumented immigrants brought to the United States as children,” the Washington Post reports.

“A string of lower courts have said that President Trump’s decision to terminate the Obama-era program was based on faulty legal reasoning and that the administration has failed to provide a solid rationale for ending it.”

“The Supreme Court would likely render its verdict during the 2020 presidential election year.”

The Polls Have the Race Right

Amy Walter: “Yes, 25 candidates are running for the nomination. But, only five to six of them are serious contenders for the nomination. The RealClearPolitics average shows that five candidates combined—Vice President Joe Biden, Senators Bernie Sanders, Elizabeth Warren, Kamala Harris and South Bend Mayor Pete Buttigieg—take between 71 percent to 76 percent of the vote in national and early state polling. Nothing that happened in these two debates changed that math.”

“Senator Cory Booker and former San Antonio Mayor Julian Castro performed well in their Wednesday night debate. But, strong enough to break into the double digits—or overcome any of those five? I don’t see it.”

Yang Claims Microphone Turned Off At Times

Andrew Yang claimed his microphone was “not on” a few times when he attempted to jump in during Thursday night’s Democratic debate, The Hill reports.

Said Yang: “There were also a few times, FYI, where I just started talking, being like, ‘Hey, I want to add something there,’ and my mic was not on.”

He added: “And it’s this sort of thing where, it’s not like if you started talking, it takes over the conversation. It’s like I was talking, but nothing was happening. And it was like, ‘Oh fuck.’ So that happened a bit too.”

Biden Campaign Denies Staff Is ‘Freaking Out’

Joe Biden’s campaign dismissed reports that staffers are “freaking out” about his performance during the second round of Democratic presidential debates on Thursday night, The Hill reports.

A source told reporter Olivia Nuzzi “that internally, field staff says the campaign-organized debate watch parties in early voting states have been ‘awkward’ and that Biden isn’t playing well to those who attended.”

She added: “He isn’t listening to his debate prep and he’s ‘set in his ways,’ the source close to the campaign tells me.”

One of the most powerful moments of last night’s Democratic debate was when Pete Buttigieg was asked about the recent police shooting in South Bend. Rachel Maddow asked why he hadn’t increased the number of black police officers on the force.

Said Buittigieg: “Because I couldn’t get it done. My community is in anguish right now because of an officer-involved shooting, a black man, Eric Logan, killed by a white officer. And I’m not allowed to take sides until the investigation comes back. The officer said he was attacked with a knife, but he didn’t have his body camera on. It’s a mess. And we’re hurting.”

Playbook: “That’s a politician taking responsibility for a shortcoming. We don’t see that much.”

Los Angeles Times: “Buttigieg spoke with evident emotion of the pain of black residents and said he was determined to bring about a day when police would inspire support instead of fear among African Americans not just at home, but everywhere. The response won’t defuse tensions. But he may get credit for not dissembling or trying to palm the blame off on others.”

Yield Curve Points to a Recession

Axios: “The U.S. Treasury yield curve has now been inverted for more than a month — meaning the 3-month bill is paying a higher interest rate than the 10-year note.”

“An inversion of Treasury bond yields is a near-perfect recession indicator that economists at the Federal Reserve recently called ‘the best summary measure’ for an economic downturn.”

The Democrats’ Turn to the Left Is Overblown

Jonathan Bernstein: “I saw a number of analysts flag the liberal positions that some candidates took as general-election vulnerabilities. Perhaps! But it’s not exactly a secret that candidates tend to play to their parties during the nomination fight and then moderate their positions when they face the larger electorate. So I’d guess that such concerns are overblown. And in a world where Republicans will call even very modest Democratic proposals ‘socialism,’ it’s not clear that supporting somewhat more liberal policies will change anyone’s perceptions.”

“That said, I’ve always thought Sen. Bernie Sanders is an exception. It’s normal to back away from a campaign promise, claim to be misunderstood or generally modify specific policy positions for the general election. Sanders just isn’t in a position to do that, and I doubt he has any interest in it. Perhaps that’s to his credit, but it makes him a very vulnerable potential nominee nonetheless. Political-science research is uncertain as to whether ideological extremism harms presidential candidates, but the truth is, there hasn’t been a comparable major-party nominee in the last century.”

“President Trump and Saudi Crown Prince Mohammad bin Salman posed next to each other for a photo of world leaders on Friday at the Group of 20 Summit in Japan, exchanging pleasantries in the process,” The Hill reports.

“Trump and the crown prince could be seen making conversation and smiling as they stood next to each other for the ‘family photo’ at the gathering of world leaders. Trump stood between the Saudi royal and Turkish President Recep Tayyip Erdogan.”

Trump Jokes with Putin About Election Meddling

Politico: “At their first meeting since the Robert Mueller’s Russia probe wrapped up, President Trump playfully warned Russia President Vladimir Putin ‘don’t meddle in the election.’”

“The seemingly off-the-cuff remark is likely to stoke agitation back in Washington, where Democrats and Republicans have blasted Trump for not taking seriously the special counsel’s report into Russia’s ‘sweeping and systematic’ campaign to disrupt the 2016 election in Trump’s favor.”

Walter Shapiro: “There is nothing that political pundits and armchair pollsters at home love as much as a flash of emotional drama in the midst of a presidential debate. And that is why everyone in the world watching American TV—whether they are in Ulan Bator, Ukraine, or Utah—will see an endless reel of Harris confronting Biden.”

“The danger, though, lies in over-hyping the lasting significance of this (cliché alert) viral moment more than seven months before the Iowa caucuses. While a strong performance throughout the evening will undoubtedly boost Harris’s fundraising and maybe her poll ratings, Biden still left the stage in his accustomed place as the candidate of Obama era continuity.”

Politico: ““In Miami, three of Biden’s top aides — Anita Dunn, Kate Bedingfield and Symone Sanders — spent 30 minutes batting away questions from skeptical reporters after the debate. They insisted that Biden performed well and made his case to the American people, and acknowledged no mistakes.”

The Supreme Court’s Green Light to Gerrymandering

Rick Hasen: “The Supreme Court decision on Thursday in Rucho v. Common Cause purports to take federal courts out of the business of policingpartisan gerrymanders and leave the issue for states to handle.”

“But the decision will instead push federal courts further into the political thicket, and, in states with substantial minority voter populations, force courts to make logically impossible determinations about whether racial reasons or partisan motives predominate when a party gerrymanders for political advantage. It didn’t have to be this way.”

The First Democratic Debate – Night Two

The second of two Democratic presidential debates starts at 9 p.m. ET. It will be broadcast on NBC News, MSNBC and Telemundo and live-streamed via NBCNews.com.

The debate features most of the top poll leaders in the race: Joe Biden, Bernie Sanders, Pete Buttigieg and Kamala Harris.

Other participants — who are barely registering in the polls — include Kirsten Gillibrand, Michael Bennet, John Hickenlooper, Eric Swalwell, Andrew Yang and Marianne Williamson.

White House Mulls Capital Gains Tax Break

“The White House is developing a plan to cut taxes by indexing capital gains to inflation, in a move that would largely benefit the wealthy and may be done in a way that bypasses Congress,” Bloomberg reports.

“Consensus is growing among White House officials to advance the proposal soon, to ensure the benefit takes effect before President Trump faces re-election in 2020.”

House Democrats Cave on Border Emergency Bill

“House Democrats will vote Thursday on a clean Senate-passed bill to address the border crisis, marking a blow to Speaker Nancy Pelosi (D-Calif.) and liberal members who had demanded additional protections for migrant children,” The Hill reports.

“Rep. Henry Cuellar (D-TX), a border lawmaker, announced the plan as he emerged from an emergency meeting in Pelosi’s office. And other lawmakers said Democratic leaders are already whipping the $4.6 billion Senate proposal.”

“Today’s Supreme Court ruling that the Constitution doesn’t bar even extreme partisan gerrymandering is the worst election-related decision since Citizens United, which in 2010 opened the floodgates for corporate money in campaigns. The Court just stacked the deck in favor of parties over voters—and laid the groundwork for yet more polarization.”
