Democratic Investigations Start Slowly

New York Times: “Democrats, transitioning into the House majority, have quietly sent dozens of letters in recent weeks seeking documents and testimony from President Trump’s businesses, his campaign and his administration, setting the table for investigations that could reach the center of his presidency.”

“Clear targets have emerged in the process, and some others appear to have fallen away, at least for now. Family separation and detention policies at the border have jumped to the forefront. So has the acting attorney general’s oversight of the special counsel, Robert S. Mueller III. But Democrats, after slamming House Republicans for their inadequate inquiry, do not plan to reopen a full-scale Russian interference investigation. They have also chosen to hold off on an immediate request for Mr. Trump’s tax returns.”

Matthew Dowd: “The Hollywood equivalent of President Trump’s speech Tuesday night on immigration would be releasing a movie for the 12th time after it bombed at the box office a little over two months ago.”

“The president’s speech from the Oval Office provided no new information for this debate we are in over the government shutdown and border security, did not expand the audience who would be receptive to the president’s message and will not move a single swing voter in America or in Congress to the president’s position.”

John Harris: “It is a good thing for Trump that he will presumably withhold a caustic Trump critique of his own performance: ‘low energy’ is one phrase that might come back in vogue. His eyes were squinty and his expression flat. The words, which often sounded more like a speechwriter’s than Trump’s own, were delivered with such slow and deliberate articulation that comic Seth MacFarlane tweeted that the 9-something-minute address ‘had the cadence of a Wheel of Fortune contestant solving the puzzle.’”

Deputy Attorney General Rod Rosenstein is expected to leave his role in the coming weeks, multiple sources familiar with his plans told ABC News.

“Rosenstein has communicated to President Trump and White House officials his plan to depart the administration around the time William Barr, Trump’s nominee for attorney general, would take office following a Senate confirmation.”

“Rosenstein apparently had long been thinking he would serve about two years, and there was no indication that he was being forced out at this moment by the president.”

Declaring an Emergency May Be Trump’s Only Way Out

NPR: “It’s unclear what happens next, with President Trump and Democrats living in different universes when it comes to immigration and border security. The president opted not to threaten or declare a national emergency Tuesday night, but could it — with all of its risks – be the only play the left?”

“That would entail him signing legislation to fund the Cabinet departments agencies that are closed and it would give him the chance to tell his base that at least he fought as hard as he could to get Congress to act. Of course, such a declaration would end up being challenged in the courts, and may be why the president chose not to go there Tuesday.”

“Neither President Trump’s televised Oval Office address arguing for his border wall nor the rebuttal from Democratic congressional leaders appeared to move either party any closer to ending the 18-day partial government shutdown, according to the reactions of lawmakers across the political spectrum late Tuesday,” the Washington Post reports.

“Instead, a review of dozens of written statements and interviews indicated, the parties have only become more entrenched in their positions — while a few wondered aloud about the point of the dueling prime-time statements carried live by the television networks.”

America’s First Openly Gay Governor

“Colorado entered a new era of Democratic political dominance Tuesday as Jared Polis was sworn in as the state’s 43rd governor, promising to make the state’s booming economy fairer and health care more affordable,” the Denver Post reports.

“Polis’ longtime partner, Marlon Reis, and their two children stood with him for the ceremony on the west steps of the state Capitol. He took the oath at precisely noon, his left hand on a siddur, a Jewish prayer book.”

“In his first speech as governor, Polis celebrated the diversity of the state and recognized the historic moment: Polis is the first openly gay governor elected to lead a state. He also is Colorado’s first Jewish governor.”

“With limited governing experience under his belt, Russell T. Vought took the helm of the Office of Management and Budget a little more than a week ago, after agencies began closing their doors.”

“In just a few days, he has used his perch to make several controversial decisions aimed at blunting the impact of the partial government shutdown — moves meant to buy President Trump more time to drag out the closure, which is on the verge of becoming the longest in U.S. history.”

“President Trump sought to go over the heads of Congress to enlist public support for his long-promised border wall on Tuesday night, raising the stakes of an ideological and political conflict that has left the doors of many federal agencies shuttered for 18 days,” the New York Times reports.

“Yet privately, Mr. Trump dismissed his own new strategy as pointless. In an off-the-record lunch with television anchors hours before the address, he made clear in blunt terms that he was not inclined to give the speech or go to Texas, but was talked into it by advisers.”

President Trump will speak to Americans from the Oval Office at 9 p.m. ET to address what he says is a crisis along the nation’s southern border. Trump is trying to pressure congressional Democrats to give him $5.7 billion to build a border wall and end a government shutdown.

Speaker Nancy Pelosi (D-CA) and Senate Minority Leader Chuck Schumer (D-NY) will give the Democratic response after the president speaks.

Murkowski Wants to Reopen Government

Sen. Lisa Murkowski (R-AK) joined calls today to reopen the rest of the federal government before the funding fight over the border wall is resolved, CNN reports.

Said Murkowski: “I am one who is amendable to a process that would allow for those appropriations bills that have concluded some time ago that they be enacted into law — whether it’s the Department of Interior or the IRS. I’d like to see that.”

O’Rourke Leaning Towards Running for President

Beto O’Rourke “is leaning toward running for president, according to four people who have spoken with him or his advisers in recent days,” Politico reports.

“But for a presidential contender, his radio silence is becoming increasingly awkward.”

“In Iowa and New Hampshire — where Democrats are accustomed to being courted aggressively by presidential contenders — calls from Democratic Party organizers to O’Rourke’s advisers go unreturned. And a report in the Wall Street Journal on Monday that O’Rourke won’t make any decision before February and is preparing for a solo road trip — but avoiding early nominating states — bewildered even his supporters.”

North Carolina Election Fraud Probed Long Before 2018

“Long before accusations of absentee ballot fraud in a small North Carolina county cast doubt on the results of a heated 2018 congressional race, a state elections investigator spent weeks probing whether the man at the center of the current scandal was among a group buying votes,” the AP reports.

“That 2010 investigation was one of at least a half dozen instances over the last nine years that prosecutors and elections officials received complaints of serious elections irregularities in Bladen County, a rural locale of 35,000 people that has long had a statewide reputation for political chicanery by both Republicans and Democrats.”

Supreme Court Won’t Intervene In Mystery Subpoena

“The Supreme Court on Tuesday declined to intervene in a mysterious subpoena fight apparently involving a foreign-government-owned company and special counsel Robert Mueller,” Politico reports.

“The unknown firm had asked the high court to block a federal judge’s contempt order and financial penalties for refusing to comply with the subpoena, arguing that the company is immune from U.S. grand jury subpoenas.”

Washington Post: “The entity that is the subject of the cloaked legal battle — known in court papers simply as a ‘Corporation’ from ‘Country A’ — is a foreign financial institution that was issued a subpoena by a grand jury hearing evidence in the special counsel investigation.”

Rick Hasen: “In a short unpublished opinion so far garnering only slight media attention, the United States Court of Appeals for the 3rd Circuit decided on Monday what may be one of the most consequential cases poised to affect the 2020 elections. The circuit upheld a district court decision ending a court order in effect since 1982 barring the Republican National Committee from engaging in ‘ballot security’ measures designed to intimidate minority voters from voting at the polls.”

“With Trump having taken over the RNC for the 2020 elections and with this consent decree no longer standing in his way, we should be concerned about a new wave of voter suppression coming from the Republican Party during the upcoming election.”
