Jonathan Chait: “Most of the public fascination surrounding the legal ordeal of President Trump has attached itself to whether (or, more accurately, how successfully) his campaign colluded with Russia. Much less attention has fixated on the question of Trump committing obstruction of justice in office.”

“This isn’t because obstruction is less serious an offense. Quite the opposite: It’s the very crime that drove President Nixon from office. Rather, it’s paradoxically because the obstruction is so public and naked that it’s been robbed of its mystery. The collusion question has enough hidden tangents to create some compelling drama about the outcome, even if the basic contours are clear. Collusion is more interesting than obstruction for the same reason that the romantic travails of Ross and Rachel are more compelling than those of two people in a porno.”

McConnell Wants McSally Appointed to Replace Kyl

Senate Majority Leader Mitch McConnell (R-KY) “is leveraging his political power to try to convince Arizona Gov. Doug Ducey (R) to choose Rep. Martha McSally (R-AZ) to replace Sen. Jon Kyl (R-AZ), who is considering leaving his seat before his term ends,” CNN reports.

“McSally, a Republican congresswoman who once worked for Kyl, lost her Senate bid two weeks ago to Democratic Rep. Kyrsten Sinema. Kyl, who was picked by the governor in September to fill the seat vacated by the late Sen. John McCain. told CNN last week he has decided whether to leave office before his term ends at the end of next year. He wouldn’t reveal his decision, but said he will talk to Ducey about it.”

Officials Discussed Sharing Census with Law Enforcement

Washington Post: “Trump administration officials have discussed ways to circumvent the confidentiality of census responses, according to documents filed Friday in a California legal challenge to adding a citizenship question to the decennial survey.”

“The subject came up after a Democratic lawmaker asked whether responses to the survey could ever be shared with law enforcement agencies, something that has been strictly illegal according to federal law governing the census.”

Troops Already Coming Home from the Border

“The Pentagon is set to begin a drawdown of its 5,800 troops from the Southwest border as early as this week, the Army commander overseeing the mission told Politico today — even as the approaching caravan of refugees prompted U.S. customs officers to close a port of entry near Tijuana, Mexico.”

“All the active-duty troops that President Trump ordered sent to the border before the midterm elections should be home by Christmas.”

White House Restores Acosta’s Press Pass

The White House has restored the press credentials of CNN’s chief White House correspondent Jim Acosta, and as a result, CNN will drop its lawsuit against the Trump administration, CBS News reports.

CNN had requested an emergency court hearing earlier today, saying the White House warned it could revoke Acosta’s press pass again at the end of the month.

GOP Tax Hike Came Back to Bite Them

“President Trump’s $1.5 trillion tax cut was supposed to be a big selling point for congressional Republicans in the midterm elections. Instead, it appears to have done more to hurt, than help, Republicans in high-tax districts across California, New Jersey, Virginia and other states,” the New York Times reports.

“House Republicans suffered heavy Election Day losses in districts where large concentrations of taxpayers claim a popular tax break — the state and local tax deduction — which the law capped at $10,000 per household. The new limit resulted in an effective tax increase for high-earning residents of high-tax states who claim more than $10,000 per year in SALT.”

Midterms Are Not Good Predictors of Presidential Elections

Stu Rothenberg: “Midterm elections and presidential cycles have such different dynamics that the two should almost never be discussed together. That will not prevent people from doing so, but they should resist the temptation.”

“Each midterm election tends to be a referendum on the incumbent president, while each presidential election is a choice between nominees.”

“Of course, a presidential re-election contest is something of a referendum on the incumbent, since a sitting officeholder seeking another term will be evaluated on the basis of his performance in addition to what he or she promises for the future.”

“But the existence of an alternative on the ballot makes a presidential year very different from a midterm year. That’s why connecting the dots from the last midterm election to the next presidential contest is so unwise.”

“A majority of Americans say a caravan of migrants now approaching the nation’s southern border poses at least a minor threat to the country,” according to the Monmouth University Poll.

“At the same time, 7-in-10 say that these migrants should be given the opportunity to enter the country if they meet certain requirements. Half are disinclined to believe that terrorists are traveling with the caravan, although 1-in-4 seem fairly certain that those claims are true.”

“Libertarian J. Smythe DuVal threw his support behind Barrow, a former U.S. House member whom he said was able to ‘fix Georgia’s broken election system’ and save tax dollars through a ranked choice voting system that would eliminate separate runoff elections.”

Conservative media is built on this insight, constructing an alternate information ecosystem, in which only conservative sources can be trusted.”

“Donald Trump, an avid consumer of conservative media, has taken this style to its next step. Trump insists he is the sole arbiter of truth. Anybody who questions Trump is by definition biased. By his circular logic, any attempt to question Trump is inherently false, since the act of challenging Trump reveals the source to be dishonest. Reporters can try to chase the lies down one by one, but they always lead back into this same logical cul-de-sac.”

“A group of Senate Democrats is suing to block Matt Whitaker from serving as acting attorney general on grounds that his placement in the post was unconstitutional,” the Daily Beast reports.

“The suit, which is being filed by Sens. Richard Blumenthal (D-CT), Sheldon Whitehouse (D-RI), and Mazie K. Hirono (D-HI) in U.S. District Court for the District of Columbia, is the latest and most aggressive salvo against the Whitaker appointment.”

Hyde-Smith Accepts $2,700 from White Supremacist
