Obama Relied on Signing Statement to Justify Prisoner Swap

Rick Klein: “The prisoner swap that won the release of Bowe Bergdahl raises a policy debate, plus a very real operational one about whether the terms were worth it to the United States. But on the law, President Obama violated a clear legal requirement — included in a December 2013 law — to notify Congress of releases from Guantanamo Bay ‘not later than 30 days before the transfer or release of the individual.’ That’s the law Obama signed. But, of course, he added a signing statement saying he disagreed with that part of the law, so he could maintain ‘the flexibility, among other things, to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers.'”

“Leaving aside the fact that the Taliban is not one of those ‘foreign countries,’ that’s what happened here. This is precisely where signing statements matter. Echoing somewhere still is what candidate Obama said of President Bush’s use of signing statements, back in 2008: ‘I believe in the Constitution, and I will obey the Constitution of the United States. We’re not going to use signing statements as a way of doing an end-run around Congress.'”

Dead Heat in Mississippi

A new PMI poll in Mississippi finds Sen. Thad Cochran (R) in a very close primary race with Chris McDaniel (R), leading his challenger by a razor-thin 42% to 41%.

Most interesting: “Indeed, the possibility of a June 24 runoff forced by a third spoiler candidate, Thomas Carey, looks increasingly likely. However, twelve percent of voters are still undecided at this late date.”

Obama Heads to Europe

New York Times: “President Obama leaves for Europe on Monday night cautiously optimistic that the crisis in Ukraine has turned a corner, but he will find himself face to face with President Vladimir V. Putin of Russia for the first time since the two squared off in a Cold-War-style showdown in Eastern Europe… Mr. Obama arrives in Poland on Tuesday to meet not only with Polish leaders but also with leaders from throughout the region who will converge there.”

“Mr. Obama and Mr. Putin will both be at Normandy on Friday for the 70th anniversary of the D-Day landings. No meetings are scheduled, but aides did not rule out an unscripted conversation.”

Cain Suggests God Might Want Him to Run Again

Herman Cain, “who at one point topped all Republican challengers during the 2012 Republican presidential primary before dropping out amidst allegations of multiple affairs, suggested on Saturday that he would return to the campaign trail in 2016 if called upon God to do so,” the Huffington Post reports.

Said Cain: “I do not know what the future holds, but I know who holds the future. And I trust in God.”

Obama Reclaims Leadership on Climate Change

“At the end of his first year in office, President Obama flew to Copenhagen and made a big promise: that the United States would cut its greenhouse gas emissions substantially by 2020 — a bold and risky pledge that hinged on a balky Congress to make it possible. His efforts became bogged down within months, and Mr. Obama’s pledge to the rest of the world soon looked like a pipe dream,” the New York Times reports.

“On Monday, Mr. Obama is planning to bypass Congress and take one of the biggest steps any American president has ever taken on climate change, proposing new rules to cut emissions at power plants. Yet, by itself, the president’s plan will barely nudge the global emissions that scientists say are threatening the welfare of future generations.”

Politico: “In interviews with more than 60 people who have had close dealings with Obama — his aides, lawmakers, friends, historians, critics and outside advisers — the portrait emerges of a president shadowed by a deepening awareness that his time and power are finite, and that two-thirds of his presidency is already in the past tense.”

“The interviews, which illuminate Obama’s thinking, outlook and choices as he navigates his second term, suggest a paradox. Often stymied at home and abroad, Obama recognizes that he is less in control of the Washington agenda than ever in his presidency — a reality that has left him deeply frustrated at times. Last week was a case study, with the Veterans Affairs scandal and resignation of Secretary Eric Shinseki eclipsing Obama’s surprise visit to Afghanistan and major foreign policy speech at West Point.”

A new USC Dornsife/Los Angeles Times poll in California finds Gov. Jerry Brown (D) “holds a commanding lead in his bid for an unprecedented fourth term, but the race among GOP candidates seeking to take him on in November has become a dead heat just days before Tuesday’s election.”

“Half of Californians deemed likely to vote in the primary supported Brown’s reelection. Among his chief challengers, both Republicans, Neel Kashkari was far behind at 18% and Tim Donnelly trailed at 13%. The difference between the two vying for the second slot in the general election was within the poll’s margin of error.”

Cuomo Defuses Third Party Threat

“Defusing a tense and potentially campaign-changing challenge from the left, Gov. Andrew Cuomo secured the endorsement of the Working Families Party on Saturday night, easing the popular Democrat’s path as he runs for re-election and solidifying his broader political prospects,” the New York Times reports.

“After weeks of negotiations and last-minute tribulations, Mr. Cuomo was able to mend rifts created by some of his centrist policies and ease the concerns of Working Families, a small but influential group of labor unions and liberal activists. In doing so, the governor — a savvy politician with rumored presidential ambitions — simplified a re-election campaign in which he hopes to win by a large, message-sending margin.”

Republicans Suggest Obama Broke Law in Prisoner Release

“Amid jubilation Saturday over the release of U.S. Army Sgt. Bowe Bergdahl from captivity by the Taliban, senior Republicans on Capitol Hill said they were troubled by the means by which it was accomplished, which was a deal to release five Afghan detainees from the military prison in Guantanamo Bay, Cuba,” the Washington Post reports.

“Top Republicans on the Senate and House armed services committees went so far as to accuse President Obama of having broken the law, which requires the administration to notify Congress before any transfers from Guantanamo are carried out.”

Clinton Was More Hawkish Than Obama

“In her final weeks as secretary of state, Hillary Clinton wrote a private memo to President Obama warning that relations with Russia had hit a low point and the heralded ‘reset’ in relations was over, according to people who saw the document,” the Wall Street Journal reports.

“Mrs. Clinton, if she runs for president, likely will lean heavily on her experience as the nation’s top diplomat. Her memo, written in January 2013, illustrates two striking features of her four years in the post: She was often more hawkish than the White House she served, and at some key moments was ineffectual at swinging policy her way.”

Cuomo Launches War on Third Party

New York Gov. Andrew Cuomo (D) “is responding to a rebellion from the state’s progressive third party by attempting to push other Democrats away from the Working Families Party,” BuzzFeed reports.

“Cuomo’s move is an escalation that raises the stakes on both sides of the ideologically charged battle, one that has brought to the fore the New York governor’s growing rift with the state’s left. Cuomo political aide and longtime enforcer Joe Percoco has, the sources said, made the request, which is aimed at threatening the party’s ability to get the 50,000 votes for governor in November’s election required for a permanent slot on the statewide ballot.”

GOP Candidates Retreat on Obamacare

“Republican candidates have begun to retreat in recent weeks from their all-out assault on the Affordable Care Act in favor of a more piecemeal approach, suggesting they would preserve some aspects of the law while jettisoning others,” the Washington Post reports.

“The changing tactics signal that the health-care law — while still unpopular with voters overall — may no longer be the lone rallying cry for Republicans seeking to defeat Democrats in this year’s midterm elections.”
