Washington Post: “The inventory of unclassified items in the boxes that were recovered earlier this year from Mar-a-Lago is roughly 100 pages long… Descriptions of items that were improperly taken to Mar-a-Lago include a cocktail napkin, a phone list, charts, slide decks, letters, memos, maps, talking points, a birthday dinner menu, schedules and more, this person said, speaking on the condition of anonymity to discuss details of the ongoing investigation.”

“There is a separate inventory for just the classified materials that were taken to the former president’s Florida residence, this person said. If the unclassified version of the classified inventory were organized in the same way as the inventory of nonclassified items, it would be about three pages long.”

“As for classification level, they range from confidential to top-secret to special handling categories.”

New York Times: “Federal prosecutors subsequently began a grand jury investigation, according to two people briefed on the matter. Prosecutors issued a subpoena earlier this year to the archives to obtain the boxes of classified documents.”

“The authorities also made interview requests to people who worked in the White House in the final days of Mr. Trump’s presidency.”

“In the spring, a small coterie of federal agents visited Mar-a-Lago in search of some documents, according to a person familiar with the meeting. At least one of the agents was involved in counterintelligence.”

Wall Street Journal: “In January, the National Archives retrieved 15 boxes of material from Mr. Trump, raising questions about his compliance with federal law requiring official records to be turned over when a president leaves office. A person familiar with the records said they include a letter former President Barack Obama left for his successor and correspondence between Mr. Trump and North Korean leader Kim Jong Un…”

“The National Archives also said that some Trump presidential records it had received had been torn up.”

The FBI search of Donald Trump’s Mar-a-Lago “began Monday morning and lasted until the evening,” the Wall Street Journal reports.

If the FBI search of Donald Trump’s home and office at Mar-a-Lago is about classified documents taken from the White House, this part of the U.S. Code is could be important.

18 U.S. Code § 2071 – Concealment, removal, or mutilation generally

(a)Whoever willfully and unlawfully conceals, removes, mutilates, obliterates, or destroys, or attempts to do so, or, with intent to do so takes and carries away any record, proceeding, map, book, paper, document, or other thing, filed or deposited with any clerk or officer of any court of the United States, or in any public office, or with any judicial or public officer of the United States, shall be fined under this title or imprisoned not more than three years, or both.

(b)Whoever, having the custody of any such record, proceeding, map, book, document, paper, or other thing, willfully and unlawfully conceals, removes, mutilates, obliterates, falsifies, or destroys the same, shall be fined under this title or imprisoned not more than three years, or both; and shall forfeit his office and be disqualified from holding any office under the United States. As used in this subsection, the term “office” does not include the office held by any person as a retired officer of the Armed Forces of the United States.

However, Jason Willick notes you can’t impose qualifications on holding the presidency by statute — the qualifications are set out in the Constitution.

The FBI executed a search warrant today at Donald Trump’s Mar-a-Lago resort in Palm Beach, Florida, CNN reports.

Trump himself confirmed the raid but declined to say why the FBI agents were at Mar-a-Lago, but he added “they even broke into my safe.”

New York Times: “The search, according to two people familiar with the investigation, appeared to be focused on material that Mr. Trump had brought with him to Mar-a-Lago, his private club and residence, after he left the White House. Those boxes contained many pages of classified documents.”

Washington Post: “Such a move — a court-ordered search of his property to look for possible evidence of a crime — is deeply unusual for a former president and represents a historic moment in Trump’s tortured relationship with the Justice Department, both in and out of the White House.”

“To take such a step would require approval at the highest levels of the Justice Department.”

“A commercial real estate firm held in contempt of court for failing to hand over records on its appraisals of several Trump Organization properties to New York’s attorney general has turned over nearly 36,000 documents,” NBC News reports.
