How the War on Terror Led to Donald Trump

November 30, 2020 at 1:13 pm EST By Taegan Goddard Leave a Comment

This is an important book: Reign of Terror: How the 9/11 Era Destabilized America and Produced Trump by Spencer Ackerman.

“What began as the persecution of Muslims and immigrants has become a normalized, paranoid feature of American politics and security, expanding the possibilities for applying similar or worse measures against other targets at home. A politically divided country turned the War on Terror into a cultural and then tribal struggle, first on the ideological fringes and ultimately expanding to conquer the Republican Party, often with the timid acquiescence of the Democratic Party. Today’s nativist resurgence walked through a door opened by the 9/11 era.”

Justices Seem Skeptical of Trump Plan on Census

November 30, 2020 at 1:09 pm EST By Taegan Goddard Leave a Comment

“The U.S. Supreme Court seemed wary on Monday of approving President Trump’s plan to exclude undocumented immigrants from the census figures that are used to calculate each state’s representation in Congress and share of billions of dollars from a host of federal programs,” NBC News reports.

“But it was unclear after 90 minutes of oral argument exactly how the court would deal with the issue given that the Census Bureau concedes it has no idea yet how many people would be excluded or when it will have the answer.”

It’s only been a matter of weeks since recordings of Melania Trump asking “Who gives a fuck about Christmas stuff?” were published—but, in a Christmas miracle, the first lady has managed to summon up the energy to unveil her fourth and final attempt at making the White House look festive, the Daily Beast reports.

In a video posted to her Twitter account, Trump can be seen walking around a deserted White House and surveying this year’s decorations.

Trump Appointees Burrow Into Civil Service

November 30, 2020 at 1:00 pm EST By Taegan Goddard Leave a Comment

At least a dozen Trump political appointees have now “burrowed” into civil service positions where they can wreak havoc on Biden’s agenda from the inside, NBC Washington reports.

“They include a high-ranking official at the U.S. Department of Veterans Affairs, at least seven political appointees in the U.S. Department of Justice and four appointees in the U.S. Department of Interior, among others.”

November 30, 2020 at 12:59 pm EST By Taegan Goddard Leave a Comment

“Sen. Chuck Grassley (R-IA) returned to work at his Washington office Monday after completing a quarantine period caused by a positive coronavirus test on Nov. 17,” the Des Moines Register reports.

“Grassley, 87, has remained symptom-free in the days since his diagnosis.”

Quote of the Day

November 30, 2020 at 12:30 pm EST By Taegan Goddard Leave a Comment

“Close the bars and keep the schools open is what we really say.”

— Dr. Anthony Fauci, when asked on ABC News what advice he would give to President-elect Joe Biden on handling the pandemic.

Senate Keeps Confirming Trump’s Nominees

November 30, 2020 at 11:36 am EST By Taegan Goddard Leave a Comment

“Less than two months remain in the Trump administration, and Senate Republicans are doing something not seen in a century — confirming judges and other nominees after their party lost the White House. That norm-breaking rush to get GOP-approved picks through could get tricky, though, if lawmakers continue missing time because of COVID-19,” Roll Call reports.

“With only one exception, post-election confirmations of judges nominated to lifetime appointments by a president whose party has lost the White House hasn’t happened since the election of 1896 when William McKinley was elected and the Senate confirmed Grover Cleveland’s picks.”

“During previous presidential election years, senators have invoked the so-called Thurmond rule, an unwritten agreement named after the late Sen. Strom Thurmond (R-SC) that calls for the chamber to stop approving circuit court nominations in the few months before Election Day.”

Bipartisan Senate Group Revives Pandemic Relief Talks

November 30, 2020 at 11:10 am EST By Taegan Goddard Leave a Comment

“A bipartisan group of senators is trying to jump-start stalled coronavirus stimulus talks during the lame duck, with congressional leaders still at odds over providing more relief as cases and deaths spike ahead of the coming winter,” Politico reports.

“The effort is an uphill battle given the entrenched positions of Majority Leader Mitch McConnell and his GOP conference and Speaker Nancy Pelosi and Senate Minority Leader Chuck Schumer. So whatever this collection of senators can achieve is likely to be modest, if they can accomplish anything at all.”

1918 Germany Has a Warning for America

November 30, 2020 at 11:00 am EST By Taegan Goddard Leave a Comment

Jochen Bittner: “One hundred years ago, amid the implosions of Imperial Germany, powerful conservatives who led the country into war refused to accept that they had lost. Their denial gave birth to arguably the most potent and disastrous political lie of the 20th century — the Dolchstosslegende, or stab-in-the-back myth.”

“Its core claim was that Imperial Germany never lost World War I. Defeat, its proponents said, was declared but not warranted. It was a conspiracy, a con, a capitulation — a grave betrayal that forever stained the nation. That the claim was palpably false didn’t matter. Among a sizable number of Germans, it stirred resentment, humiliation and anger. And the one figure who knew best how to exploit their frustration was Adolf Hitler.”

Trump Slams ‘Hapless’ Georgia Governor

November 30, 2020 at 10:35 am EST By Taegan Goddard Leave a Comment

President Trump continues to slam Georgia Gov. Brian Kemp (R):

“Why won’t Governor Brian Kemp, the hapless Governor of Georgia, use his emergency powers, which can be easily done, to overrule his obstinate Secretary of State, and do a match of signatures on envelopes. It will be a ‘goldmine’ of fraud, and we will easily WIN the state…”

“Also, quickly check the number of envelopes versus the number of ballots. You may just find that there are many more ballots than there are envelopes. So simple, and so easy to do. Georgia Republicans are angry, all Republicans are angry. Get it done!”

Republicans Ready to Become Deficit Hawks Again

November 30, 2020 at 10:30 am EST By Taegan Goddard Leave a Comment

“Republicans are preparing to reembrace their inner deficit hawks after greenlighting big spending bills under President Trump,” The Hill reports.

“GOP senators say they expect to refocus on curbing the nation’s debt and reforming entitlement programs starting in 2021, as the Congressional Budget Office estimates that the debt has surpassed the size of the American economy.”

Andrew Yang Said to Be Considering Mayoral Bid

November 30, 2020 at 10:00 am EST By Taegan Goddard Leave a Comment

“Former presidential hopeful Andrew Yang, who advocated for a “universal basic income” during the Democratic primary, is now the subject of a poll that tests New York City voters’ appetites for a third-party candidate in the upcoming mayoral race,” Politico reports.

“The poll did not indicate it was being conducted on Yang’s behalf… but several questions focused on his potential candidacy — something his team said he was weighing as recently as last month. Others asked respondents to gauge a nameless candidate, whose description closely matched Yang’s profile.”

November 30, 2020 at 9:35 am EST By Taegan Goddard Leave a Comment

A Failure of Analysis

November 30, 2020 at 9:31 am EST By Taegan Goddard Leave a Comment

The following piece for members is from Robert M. Shore, who as a partner of Raines Feldman LLP focuses on appellate work and constitutional law.

Just before Thanksgiving, the Supreme Court’s issued a dead-of-night decision intended to signal sharp limits on government’s ability to limit religious services in the name of pandemic safety. Shortly before midnight Wednesday night, the Court issued an emergency injunction preventing New York State from imposing strict numerical limits on worship services — limits that New York had already lifted. In the words of Chief Justice Roberts, the Court was “telling the Governor not to do what he’s not doing.”
