John Yoo, who held a top job in the Justice Department’s Office of Legal Counsel under George W. Bush, tells the Washington Post that the most important consequence of the Mueller report “is no longer whether the evidence on obstruction would support a criminal charge.”
Said Yoo: “Barr has settled that matter by finding no grounds to prosecute. A declination to prosecute is very difficult to overturn.”
But he added: “The report has a different, most important function here: It could provide sufficient evidence for the House to bring impeachment charges. The standard for impeachment is not solely that the President committed a crime; it could include matters of bad character or judgment, as well as disastrous policy. It is entirely possible that the report could provide evidence that does not support an obstruction charge in a federal courtroom, but could provide the grounds for impeachment proceedings in the House of Representatives.”
