Three dynamics became immediately clear today in the Capitol as the Senate began to grapple with the likelihood that Roe v. Wade will be overturned, Punchbowl News reports.

  • Senate Democrats don’t have the votes to set aside the filibuster to codify Roe into law, even though Democrats are increasingly eager to do away with the 60-vote threshold in order to protect abortion rights.
  • At the moment, Senate Republicans are focused squarely on the fact that the decision leaked from the usually air-tight Supreme Court.
  • Senate Democrats will try to force a vote on codifying the right to an abortion, but Republicans are certain to stop it.

The internal disarray the leak suggests, wholly at odds with the decorum prized by Chief Justice John Roberts, was a blow to the legitimacy of the court.”

Sen. Joe Manchin (D-WV) is standing firm on his commitment to the legislative filibuster in light of a report on a Supreme Court draft opinion that could possibly overturn abortion rights around the country, Politico reports.

Said Manchin: “The filibuster is the only protection we have in democracy.”

Senate Minority Leader Mitch McConnell (R-KY) — perhaps not coincidentally picking up on a rant last night from Laura Ingraham, who once clerked for Justice Clarence Thomas — called the leak “an attack on the independence of the Supreme Court” which he blamed on the “radical left.”

Roberts Orders Investigation of Supreme Court Leak

Chief Justice John Roberts said that the leaked draft opinion that proposes overturning Roe v. Wade is authentic but not final, and he is opening an investigation into how it became public, the Washington Post reports.
