Big Mistake by Utah’s Attorney General

Andrew Koppleman says “an underreported story in the Utah same-sex marriage case is the incompetence of the Utah Attorney General’s office in litigating the case.”

“Typically, in same-sex marriage litigation, the state accompanies its pleadings with a routine request that, if the trial court rules in favor of the same-sex couples, that ruling be stayed pending the inevitable appeal. That way no licenses can issue until the question is finally resolved. Until now, courts have generally agreed that the question of same-sex marriage is doubtful enough that the status quo should be preserved during the litigation. Everyone agrees that it would be unfortunate for marriage licenses to issue, and couples to order their lives in reliance on them, only to have those licenses voided on appeal.”

“In Utah, however, the state inexplicably neglected to request a stay before the ruling issued.”

Benefits End for One Million Unemployed

“An emergency federal program that acts as a lifeline for 1.3 million jobless workers will end on Saturday, drastically curtailing government support for the long-term unemployed and setting the stage for a major political fight in the new year,” the New York Times reports.

“The program, in place since the recession started in 2008, provides up to 47 weeks of supplemental unemployment insurance payments to jobless people looking for work. Its expiration is expected to have far-reaching ramifications for the economy, cutting job growth by about 300,000 positions next year and pushing hundreds of thousands of households below the poverty line.”

“When the federal program expires, just one in four unemployed Americans will receive jobless benefits — the smallest proportion in half a century.”

Stockman Faces Questions Over ‘Excessive Donations’

Rep. Steve Stockman (R-TX) again has been questioned by the Federal Election Commission for allegedly “excessive contributions” from donors sympathetic to an East Texas tribe’s efforts to gain rights to open a casino, the Houston Chronicle reports.

The AP reports Stockman’s campaign “has been hamstrung by reported problems with its finances and reporting income. Stockman recently dismissed two congressional staffers for making prohibited contributions, and a recent Chronicle investigation found that Stockman long failed to file federal campaign finance disclosure forms.”

NSA Phone Surveillance Found Legal

A federal judge “ruled that the National Security Agency’s program that is systematically keeping phone records of all Americans is lawful, creating a conflict among lower courts and increasing the likelihood that the issue will be resolved by the Supreme Court,” the New York Times reports.

Washington Post: “The decision conflicts with that of a U.S. District Court judge who ruled against the government early last week, finding that the NSA’s program was almost certainly unconstitutional. The divergent decisions make it more likely that the Supreme Court will make its own ruling.”

Utah Ruling Heads to Supreme Court

“In June, when the Supreme Court stopped short of deciding whether the Constitution guaranteed a right to same-sex marriage, many thought the court had bought itself several years before it had to confront the question again,” the New York Times reports.

“But the issue will soon return to the court, with officials in Utah saying that within the next few days they will ask the justices to block a trial judge’s decision last week that allows same-sex couples to marry there.”

Rick Hasen: “It is fairly likely that the Court grants a stay to keep the status quo as things progress in the 10th Circuit. That will buy the Court some time. But not that much. I expect within a year or two this case or another will make it to the Court in a way that leads the Court to decide the same-sex marriage issue on the merits. There are just too many questions, and so much litigation, for the Court to avoid the merits for too long.”

President Obama “broke from his vacation in Hawaii on Thursday to sign a stack of legislation that included the bipartisan budget deal and funding legislation for the Pentagon,” The Hill reports.

“Many in Washington are hopeful that the budget agreement will pave the way for more bipartisan deal making in 2014 after one of the least productive years on record for Congress… But a number of contentious fiscal issues loom in 2014, including another fight over the debt ceiling, and there’s no guarantee that the budget agreement will ward off another shutdown in January.”
