Politico: “With Kavanaugh considered likely to win confirmation absent a major misstep, Democrats must keep pushing against long odds while carving out an upside to potential defeat. They’re readying an intense volley of questions for the 53-year-old appellate court judge on hot-button liberal issues from abortion to the Russia probe and aiming to create viral social media moments from particularly controversial exchanges in the hopes of chipping away at Kavanaugh’s credibility.”

“Even if Democrats can’t quash Kavanaugh’s confirmation, though, they know they’ll have to walk away from the fight with the minor victory of weakening Kavanaugh’s public persona and forcing Republicans to come up with the votes to approve him before a single one of their members comes off the fence.”

The Brett Kavanaugh Supreme Court hearings will be, as The New York Times editorial page labeled them, a “charade.” With the Republicans in firm control and the Democrats stripped of their ability to filibuster, Kavanaugh’s confirmation is all but a foregone conclusion, and the hearings will amount to little more than a pro forma spectacle to humor Americans that the Senate is doing its job.

Bush Lawyer Releases 42K Kavanaugh Documents

“Hours before the start of hearings on Brett Kavanaugh’s nomination to the Supreme Court, the lawyer for former president George W. Bush turned over 42,000 pages of documents from the nominee’s service in the Bush White House, angering Senate Minority Leader Charles Schumer, who issued what is certain to be a futile call to delay the proceedings,” the Washington Post reports.

Said Schumer: “Not a single senator will be able to review these records before tomorrow.”

“Senate Democrats plan to hammer President Trump’s Supreme Court nominee Brett Kavanaugh over his views on abortion and presidential power in hearings starting on Tuesday, but the conservative judge looks likely to be confirmed,” Reuters reports.

”Trump’s fellow Republicans hold narrow majority control of the Senate so they can approve Kavanaugh if they stay united. So far, there were no signs of defections, with the Senate likely to vote by the end of the month.”

Kavanaugh May Soon Unshackle All Rich Political Donors

Rick Hasen: “By the time President Donald Trump runs for reelection in 2020, he might be able to accept unlimited campaign contributions to support his bid, thanks to his nomination of Judge Brett Kavanaugh to the United States Supreme Court. Documents released ahead of Kavanaugh’s confirmation hearings this week that date from his time in George W. Bush’s White House reveal that the judge just might be ready to strike down what’s left of federal law limiting contributions to candidates, as a First Amendment violation. There are two cases heading to the Supreme Court that would allow him to do just that.”

Democrats Raise Alarm Over Kavanaugh Documents

“Democrats are expressing alarm over the Trump White House decision to claim executive privilege and withhold some 100,000 pages of documents from Supreme Court nominee Judge Brett Kavanaugh’s time with the George W. Bush administration,” ABC News reports.

“More than 400,000 other pages have been handed over to the Senate Judiciary Committee, but Democrats say the withheld documents would give details and color to Kavanaugh’s time as White House Counsel in the Bush White House — when he was involved in some of its most controversial decisions and judicial nominations.”

“It’s a time Democrats say is key in giving context to his time as a partisan Republican.”

Klobuchar Says Kavanaugh Confirmation ‘Not Normal’

Sen. Amy Klobuchar (D-MN) “criticized Republicans on Sunday for the unprecedented way they are conducting the confirmation process for Brett Kavanaugh,” the HuffPost reports.

Said Klobuchar: “It’s not normal because we are not able to see 100,000 documents because the administration has said we can’t see them, exerting their executive power.”

She added: “I think that you could ask some very interesting questions about these documents that I’m unable to even say.”

Kavanaugh Won’t Recuse from Probe-Related Matters

“At his Senate confirmation hearings next week, Supreme Court nominee Judge Brett Kavanaugh is not expected to offer any commitment to recuse himself from cases involving investigations of President Trump, including a possible constitutional fight over a subpoena of the president,” ABC News reports.

“Democrats have said they plan to use the confirmation hearings to spotlight Kavanaugh’s potential legal and ethical conflicts should Mueller bring any case involving the president before the high court. As part of that strategy, Democrats announced former White House Counsel John Dean, who helped bring down former President Richard Nixon, will testify as an outside witness.”

“On Monday, Kavanaugh participated in his last full moot court session, which lasted nearly the entire day. Sitting in a large office in the Eisenhower Executive Office Building, he took questions from aides who played key members of the committee, mimicking their style of questioning,” Politico reports.

“The mock hearing room has been outfitted with a dais, nametags, microphones and a clock with red and green lights meant to keep his answers within the allotted time limit. The sessions, which are often referred to as ‘murder boards,’ have also featured faux protesters to make sure Kavanaugh stays cool in the event of a mid-hearing outburst.”

Pence Says Democrats Not Being Respectful to Kavanaugh

Vice President Mike Pence blamed a lack of progress on Brett Kavanaugh’s nomination to the Supreme Court in the Senate on Democrats, tweeting that in a more “respectful time” Kavanaugh would already be on the court.

Said Pence: “Justice Antonin Scalia was confirmed 98-0 and Justice Ruth Bader Ginsburg received support of 96 Senators. If we lived in a more respectful time, Judge Brett Kavanaugh would be overwhelmingly confirmed by the United States Senate.”

Hirono Cancels Meeting with Kavanaugh

Sen. Mazie Hirono (D-HI) “canceled her upcoming meeting with Supreme Court nominee Brett Kavanaugh because of the alleged legal troubles surrounding President Trump,” Politico reports.

Hirono accused the president of being “an unindicted co-conspirator in a criminal matter” and said he “does not deserve the courtesy of a meeting with his nominee—purposely selected to protect, as we say in Hawaii, his own okole.”

Voting for Kavanaugh Could Hurt Collins In 2020

A new Public Policy Polling survey in Maine finds that if Sen. Susan Collins (R-ME) votes for Brett Kavanaugh’s nomination to the Supreme Court, 47% of Maine voters said they would be less likely to vote for her when she runs for re-election, while 31% said they would be more likely to support her.

Key findings: 49% of Maine voters think Collins should vote against Kavanaugh and 56% don’t think she should vote on the nomination until there’s been a full review of Kavanaugh’s documents.

Kavanaugh Has Lowest Public Support Since Bork

A new CNN poll finds Brett Kavanaugh receives a cooler public reception than nearly every Supreme Court nominee for the last four administrations.

“Women are a driving force behind the tepid response, with fewer than three in 10 saying Kavanaugh ought to be confirmed.”

“Overall, 37% of Americans say they’d like to see the Senate vote in favor of his confirmation. Kavanaugh’s support is the lowest in polling dating back to Robert Bork’s nomination by President Ronald Reagan in 1987.”

Jones Heckled Over Upcoming Kavanaugh Vote

Doug Jones (D-AL) “was heckled at a town hall meeting Monday night in Birmingham when a woman threw a pair of stuffed lips in the senator’s direction while venting her anger that Alabama’s junior senator is keeping an open mind on U.S. Supreme Court nominee Brett Kavanaugh,” the Birmingham News reports.

Said the woman: “You have enough information. We love you. But you will vote no. And you have enough information to vote no. You can kiss my ass if you vote yes. You can kiss my ass if you vote yes. You can kiss my ass.”

Kavanaugh Urged Starr Not to Indict Clinton

“On Christmas Eve 1998, five days after the House impeached President Bill Clinton, Brett Kavanaugh urged his boss — Kenneth W. Starr, the independent counsel — not to pursue a criminal indictment of Mr. Clinton until after he left office,” the New York Times reports.

“Judge Kavanaugh, now President Trump’s nominee to fill the Supreme Court seat left vacant by the retirement of Justice Anthony M. Kennedy, delivered the advice in a private memorandum made public on Friday by the National Archives in response to a Freedom of Information Act request.”

Democrats All But Concede Kavanaugh Nomination

“Democrats have all but acknowledged that they are unable to stop the Senate from confirming Trump nominee Brett Kavanaugh for the Supreme Court this fall,” the Washington Post reports.

“Moderate Republican senators such as Susan Collins of Maine, the most closely watched GOP swing vote, are sending strong signals that they will back Kavanaugh. Several Democrats facing difficult reelections this year have indicated they are open to voting for the judge. And leaders of the resistance are already delivering post-mortem assessments and blaming fellow Democrats for a looming failure.”

Kavanaugh Hearings Set for September
