Barr Didn’t Even Pretend He’s an Honest Broker

Andrew Cohen: “There’s no great mystery about what Attorney General William Barr did Wednesday during his testimony before the Senate Judiciary Committee. He knows that Senate Democrats don’t have the votes or the power to do anything substantial to impair his tragic choice to protect President Trump from the substantiated allegations against him. And so the nation’s chief law enforcement official and top prosecutor, at taxpayer expense, spent hours spinning like a defense attorney with his client’s liberty on the line. If every prosecutor was so keen to forgive and forget compelling evidence of criminal conduct the nation’s prisons would be empty.”

“It was as disgraceful a performance by an attorney general as I have seen in 22 years as a legal analyst and commentator. And I say that having extensively covered the hapless appearances of Alberto Gonzales. He was the attorney general at the heart of the Bush administration’s U.S. Attorney scandal a decade ago. At least he had the excuse of being as dumb as a rock. Barr is no dummy. He knows precisely what he’s doing. His audience is an audience of one. It always has been. And he made it clear Wednesday, as if it had not been before, that he is no honest broker for the Justice Department. He’s just another hack.”

House Democrats Hold Firm on Barr Testimony

“The House Judiciary Committee on Wednesday teed up a clash with the Justice Department that could make Attorney General William Barr a no-show for his hearing before the Democrat-led panel,” Politico reports.

“After a tense, party-line vote, the committee endorsed ground rules for Thursday’s hearing on special counsel Robert Mueller’s report that Barr has already objected to and over which he has threatened to boycott the hearing, according to aides. At issue is a Democratic demand to let committee lawyers question Barr for an hour after lawmakers have their chance to grill the attorney general. Barr said through a spokeswoman earlier this week that it would be inappropriate for staffers to participate in the questioning.”

Tensions Between Barr and Mueller?

Washington Post: “Barr and Mueller are reported to be friends, but one comment in particular suggested there might be some tension between them. When discussing Mueller’s letter and their conversations, Barr suggested Mueller could have prevented all of this in the first place.”

Said Barr: “I offered Bob Mueller the opportunity to review that letter before it came out and he declined.”

“Barr’s intent might have been more to suggest he did his due diligence in releasing the letter — rather than that Mueller did anything wrong. But it sure sounded like he was saying Mueller could have spoken up sooner.”

“Barr also suggested later that Mueller’s opinions don’t really matter, because he serves in the Department of Justice and reports to the attorney general. He likened Mueller to a U.S. attorney in the DOJ’s pecking order.”

First Read: “If Obama Attorney General Loretta Lynch’s tarmac meeting with Bill Clinton was a 3.0 on the political Richter scale, then special counsel Robert Mueller’s complaint about Trump Attorney General William Barr’s summary of his report on Russian interference is an 8.5. At least.”

“And guess what: Barr testifies before the Senate Judiciary Committee at 10:00 am ET.”

“Democrats have a decision to make: Do they focus their fire on Barr, with some Democrats and 2020ers calling for the attorney general’s impeachment? Or do they keep the impeachment focus on Trump? Or all of the above?”

Playbook: “Bill Barr is likely to get a rough ride today in his highly anticipated hearing before the Senate Judiciary Committee. Democrats will press the attorney general about the bombshell news — which broke on the eve of his testimony — that special counsel Robert Mueller had sent him a previously undisclosed letter disputing Barr’s summary of his work.”

“Hill Democrats are blasting Barr, accusing him of misleading the public and demanding he release Mueller’s letter. Some say he should resign. They’re also insisting the special counsel testify before Congress, but say the Justice Department is slow-walking their attempts to lock in a hearing date.”

Barr Once Decried ‘Hatchet Jobs’ on Ken Starr

William Barr said in a 1998 interview that he was “disturbed” that Attorney General Janet Reno had not defended independent counsel Ken Starr from “spin control,” “hatchet jobs” and “ad hominem attacks,” CNN reports.

“Attorney General William Barr plans to hold a news conference Thursday to discuss special counsel Robert Mueller’s final report, President Trump said during a radio appearance, adding a must-see-TV event to the day he will release the long-awaited document,” the Washington Post reports.

“The press conference will occur at 9:30 a.m., and Barr, who will appear with Deputy Attorney General Rod Rosenstein, will take questions. It was not immediately clear whether it would occur before or after the report’s release.”

Barr Misled Congress in 1989 Summary Memo

Just Security: “On Friday the thirteenth October 1989, by happenstance the same day as the ‘Black Friday’ market crash, news leaked of a legal memo authored by William Barr. He was then serving as head of the Justice Department’s Office of Legal Counsel (OLC). It is highly uncommon for any OLC memo to make headlines. This one did because it was issued in ‘unusual secrecy’ and concluded that the FBI could forcibly abduct people in other countries without the consent of the foreign state. The headline also noted the implication of the legal opinion at that moment in time. It appeared to pave the way for abducting Panama’s leader, Gen. Manuel Noriega.”

“Members of Congress asked to see the full legal opinion. Barr refused, but said he would provide an account that ‘summarizes the principal conclusions.’ Sound familiar? In March 2019, when Attorney General Barr was handed Robert Mueller’s final report, he wrote that he would ‘summarize the principal conclusions’ of the special counsel’s report for the public.”

“When Barr withheld the full OLC opinion in 1989 and said to trust his summary of the principal conclusions, Yale law school professor Harold Koh wrote that Barr’s position was ‘particularly egregious.’ Congress also had no appetite for Barr’s stance, and eventually issued a subpoena to successfully wrench the full OLC opinion out of the Department.”

“When the OLC opinion was finally made public long after Barr left office, it was clear that Barr’s summary had failed to fully disclose the opinion’s principal conclusions.”

Barr Confirmed as Attorney General

The U.S. Senate voted to confirm William Barr as attorney general, “putting him in command of the Justice Department at one of the most politically charged moments in its history,” the Washington Post reports.

“Once Barr is sworn in, he will be thrust into supervising the special counsel probe into whether President Trump’s campaign worked with Russia to swing the 2016 election — and will be saddled with the political baggage that comes with it.”

“Barr, who has said he considers Mueller a friend, will oversee the probe at a particularly sensitive time, as it is widely presumed that Mueller is nearing the end of his work and lawmakers and the public are growing eager to learn his conclusions.”

“President Trump was startled Tuesday as he watched television coverage of his nominee for attorney general describing a warm relationship with the special counsel Robert Mueller in front of the Senate Judiciary Committee,” CNN reports.

“While Barr said during his hearing that Trump ‘was interested’ in hearing about the friendship, the details that emerged this week caught the President off guard, the three sources said. He bristled at Barr’s description of the close relationship, complaining to aides he didn’t realize how much their work overlapped or that they were so close.”

Barr Suggests Mueller Report Might Not Be Made Public

In a back-and-forth with Sen. Mazie Hirono (D-HI), Attorney General nominee William Barr “threw cold water on the notion that special Robert Mueller’s report might be made public,” the Washington Post reports.

Said Barr: “As the rules stand now, the rules I think say the special counsel will prepare a summary report on any prosecutive or declination decisions, and that shall be confidential and be treated as any other declination or prosecutive material within the department.”

“Declination memos are written by Justice Department officials when they decline to file charges against individuals, essentially ending an investigation. Those memos are held very closely inside the government and not released to the public. By comparing any Mueller report to a declination memo or a prosecution memo, Barr’s answer suggested the long-awaited report from the special counsel may not see the light of day.”
